French Municipal elections of 2008

The French municipal elections of 2008 , will elect the municipal councils of the common Frenchwomen. Originally programmed in 2007, the French municipal elections were shifted in 2008 not to overload the electoral calendar, which envisaged five expiries this year. These elections will proceed the 9 and March 16th, 2008.

Organization of the elections

For the elements relating to the electoral mode, the right to vote of the citizens, the methods of candidatures, etc, it is advisable to refer to the principal article: French Municipal election. Certain evolutions relate to the elections of 2008 specifically, and are developed in the following paragraphs.

Term of the office

The mandate of the city council men remains fixed at six years, according to the article L. 227 of the electoral code, even if the mandate of the mayors elected in 2001 were thus prolonged in one year a derogatory way by the law n° 2005-1563 of December 15th, 2005, which applies a provision similar to the general advisers and the senators.

Even if these elections have a local importance, the fact that all the communes vote at the same time is an indicator of the popularity of the parties, especially in the cities where the elections are usually played little thing.

The elected officials, as a Great Electors senatorial, will vote in September 2008 to elect the senators of the series has for some 6 years mandates.

Parity Men/Women

In order to implement the constitutional revision of July 8th, 1999, which supplemented article 3 of the Constitution of 1958 by the paragraph “the law supports the equal access of the women and the men to the electoral mandates and elective functions ”, the Law of June 6th, 2000 modified the article L 264 of the Electoral code, while laying out that “ the difference between the number of the candidates of each sex cannot be higher than one. Within each whole group of six candidates in the order of presentation of the list must appear an equal number candidates of each sex ”.

This rule contributed to improve the participation of the women in the municipal councils at the time of the municipal poll of 2001, but had little effect on feminization of the mayors and their assistants. This is why the law n°2007-128 of January 31st, 2007 again modified the article L 264 of the electoral code, which lays out from now on that “ the list (of the candidates) is alternatively made up of a candidate of each sex ”. This provision will apply for the first time to the municipal elections of 2008.

Moreover, the article L 122-4-3 lays out that " In the communes of 3.500 inhabitants and more, the assistants are elected with the list system in the majority absolute, without mixing nor preferential vote. On each list, the difference between the number of the candidates of each sex cannot be higher than a ". That thus introduced the parity into the functions of associated with the mayor lorqu' there are several stations of assistants created by the Municipal council, the minimum legal number remaining that of only one (and consequently it remains elected with the uninominal system).
