Freedom of teaching

The freedom of teaching is the right to found and direct an establishment of private education, to teach there, as that for any pupil to attend such an institution.

In France, the mode of freedom of teaching is defined by the law Debré of December 31st, 1959, which distinguishes three types of private educational establishments, according to their legal and financial relationship with the State, via the contractualisation:

  • private establishments except contract, which are free contents of the exempted lesson;

  • private establishments under simple contract with the State, free of the recruitment of their teachers, paid private law, but remunerated by the State;
  • private establishments under contract of association with the State, whose teachers, like those of public education, are public agents recruited by contest.
