Freedom of education

The freedom of education is the right for any person to create a school and the right for the parents, their children or the students to be educated in the school of their choice or directly by the parents (Instruction at the house). In certain countries the inscription in a system public, or directed by the government, is obligatory and the individuals are not authorized to found schools without authorization. In theory the freedom of education involves the suppression of any monopoly.

Legal protection of the freedom of education

The freedom of education was included in several constitutions: the European Convention of the human rights (Article 2 of the first Additional protocol), the Belgian Constitution and the Dutch Constitution.

In the United States the freedom of education is not explicitly guaranteed by the Constitution but it was regulated like belonging to the " freedoms of the citizens of the " United States;.
