Election of the 17th Bundestag

The election of the 17th Deutscher Bundestag must take place in 2009, with less than one dissolution of the Bundestag (Article 63 or 68 GG) or, in a less probable way, prolongation of the legislature because of a situation of defense (Article 115 H GG).

Date

The election must take place as soon as possible forty six months and at the latest forty-eight month after the meeting constitutive of the preceding Bundestag (Article 39 GG). The 16th Bundestag, elected in 2005, being made up on October 18th, 2005, the elections must take place between on August 18th and on October 18th, 2009.

Since the election must be organized a Sunday or a Bank holiday (Article 16 BWahlG), the possible dates are the 23 or the August 30th, the 6, the 13, the 20 or the September 27th, the October 3rd (day of the German Unit, i.e. national festival), the 4, the 11 or the October 18th 2009.

The date of the poll will be stopped by the federal president, which generally decides in dialog with the Federal government and the provincial governments.

The three last elections took place the third or fourth Sunday of September; in 2009, they would be the 20 or on September 27th.

Organization

598 seats will be to provide, to which will be added if necessary additional mandates. This figure can be changed by a revision of the law on the federal elections ( Bundeswahlgesetz , BWahlG); however, it is of tradition that a modification of the number of seat does not apply to the election which follows immediately, but to that according to.

A revision of the districts for the first voice is also possible.

Political personalities of various parties proposed the lengthening of the duration of the legislatures from four to five years. Such a reform of the Fundamental law would enter however into force only at the beginning of the next legislature, i.e. it could not apply to the next elections.
