Directive 91/414/CEE

The directive 91/414/CEE of the July 15th 1991 concerning the marketing of the phytopharmacological Produits is the European directive on the authorization, the marketing, the use and the control inside the European Union of the phytopharmacological products in their commercial form .

The principal goal of this directive is to harmonize the whole of the various regulations and phytopharmacological authorizations of products of the Member States within the European Union. The final decision of marketing authorization of the various products remaining the choice of each Member State. The Directive provides an exhaustive list (Appendix I) of active substances being able to be built-in the phytopharmacological products.

Before inscription, each active substance is entrusted to a Member State which becomes " Rapporteur" member;. The Member Rapporteur is charged to direct and carry out the toxicological and ecotoxicological revaluation of the active substance. At the end of the process and within sight of the results it is decided to register or not the active substance on appendix I of the directive.

It should be noted that following this decision the Member States can authorize the marketing only of phytopharmacological products composed of active substances included in appendix I of the Directive. However for the substances prohibited, some profit, for certain uses, of a derogatory time differing the prohibition of marketing from the corresponding phytopharmacological preparations. This additional time has the aim of allowing the development of an effective solution to replace the substance concerned, whenever their employment does not present an unacceptable risk, and where their withdrawal causes a technical dead end presenting a particular economic issue.
