Desmares stop

The stop Desmares is a judgment delivered by the second civil court of the French Court of appeal. It establishes a particularly severe mode within the framework of the liability for the things (Article Al 1st).

By this decision, the Court of appeal rejects the causes of exemption which do not have the characters of the foreign force. It constituted, with the eyes of the doctrines, a provocation with the reform of the mode of civil responsibility of the traffic accidents, which will lead to the reform of 1985.

Before the decision

Against fallen the night, in agglomeration, the motor vehicle of Mr. Desmares runs up against and wounds a couple of passers by which crossed the road. The passers by, Mr. and Mrs. Charles, require of Mr. Desmares and his insurer repair of their damage.
