Criminal procedure code (France)

In French Right, the Criminal procedure code is the code which gathers the legislative standards relating to the Penal procedure.

Come into effect on March 2nd, 1959 over the metropolitan territory and on March 1st 1962 the departments and overseas territories, it appears by two requirements: safety and freedom, being made the echo of the claims of the ideals of the Resistance and with the need for guaranteeing a worthy procedure (sincerity of the evidence, not of forced consents, not of recourse to opiates).

It has three main aims:

  • to reinforce individual freedom,
  • to reinforce the authority of the Magistrate S,
  • to reinforce the effectiveness of the penal procedure.

  • regulation of the Police custody and Detention pending trial,
