Court of state security

The Cour of state security is a Juridiction of exception the purpose of which is to consider the people marked to carry breach of security of the State.

Such a court exists today in several countries. But for reasons of transparency and equity, the democratic countries give up it gradually to entrust these businesses to the local juridications.

In France, the Court of state security was created by the Loi S 63-22 and 63-23 of the January 15th 1963.

Origin

Its mission was to consider in times of peace, the crimes and the offenses attacking safety interior and external of the State, like espionage and terrorism. It was competent on the entirety of the national territory.

It was doubtless created following the events in Algérie (like the attacks of OAS). It was intended to replace the various temporary jurisdictions of exception installation by the general de Gaulle.

François Mitterrand had very highly criticized the Court in its book the permanent Coup d'etat , published in 1964, and in several of its articles published then. Arrived at the capacity in 1981, it removes it, following a Bill of Robert Badinter then Ministre for Justice. The project was voted by the Sénat the July 28th 1981, by the National Assembly in second reading the July 29th and became thus the law n° 81-737 of the August 4th, appeared with the Official journal the August 5th.

The following year a law establishes that the " crimes and offenses against the fundamental interests of the nation " are judged by jurisdictions of common right.
