Convention with the land register
Convention
In Belgium, the administration of the Cadastre, become temporarily ACED (Central administration of the Recording and Fields) established a convention with the independent geometrician-experts.This convention organizes a collaboration privileged between the administration and the geometrician as regards clothes industry of plans, information exchange and consultation of cadastral information. Convention relates to all the types of plans (plane joints or not joined to the acts, official reports of measuring and/or demarcation, etc) which carries out the geometrician.
The mission of the geometrician
The geometrician must carry out his plans by respecting the very elementary schedule of conditions according to:-
indication of the date of measuring;
- indication of the scale of the plan and the direction of the Northern ;
- complete designation of the cadastral pieces concerned: commune, cadastral division, section, number;
- indication length of all the segments of the measured part and the coordinates of each top and, at all events, all the geometric standards allowing to reconstitute later on and in an unambiguous way, the boundary points on the ground at the beginning of raised durable fixed points of sufficient number (corner of building,…) ;
- indication of the dimensions of measuring and the necessary informations to the drawing of (of) the new (S) piece (S) and to the calculation of its (their) surface;
- indication on each plan of the coordinates of the tops of property and the buildings being used for fastening;
- indication on each plan of a table taking again the numbers of the pieces (including the contiguous close pieces) with, in glance, the name of the owner and a box planned for its signature (in order to more not have one nonidentifiable cluster of signatures in a corner of the plan);
- brief description of the nature of the limits of property (wall, hedge, fence…) with indication of the joint or privative character of the separative elements of property;
- detailed description of the tops of limits of property (pile, limits, corner, stock…)
- as far as possible, the signatures of the close owners will be required by the geometrician in order to make legal and opposable the limit with those.
- in the event of allotment, indication of the number of the batch, the date and the number of the license to parcel out;
- if the good is next to the public domain, the exact denomination of the way or the river;
- indication of the surface except for the centiare.
After making of the act, the notary must Ne varietur return to the geometrician two specimens of the plan signed by him and the people taking share to the act.
The geometrician preserves some for his files and returns the other to the Land register, accompanied by a listing of the points on support.
Engagements of the administration
In exchange of that, the administration provides (in control concerned) the officially agreed geometrician-expert, a free access to all patrimonial documentation and the plans sent by the other geometricians. If a document is absent from documentation of control, the geometrician-expert can obtain the same document at Management of the Land register, but against payment.
The officially agreed geometrician-expert obtains copies free from them.
Why require an officially agreed geometrician-expert?
The final customer draws several advantages to call upon an officially agreed geometrician-expert:-
guarantee that the documents will be in conformity with the requirements of the administration and that there will be no refusal of change. (If a plan is unusable for lack of elements, the land register and the recording can refuse the nutation or the recording of the act, thus causing a overcost for the customer…) ;
- the cost of the services will be less low being given the exemption from payment of the expenses of cadastral document retrieval (the nonofficially agreed geometricians can obtain only certain documents near the administration and against payment and with a time of ordering of a fifteen or so days);
- speed of obtaining this information.
