Contractual freedom

The contractual freedom is the postulate according to which the Individu S must be free S to define themselves the terms of their clean Contrat S, without any interference of Others. It is the guiding principle as regards Consentement from which rises two consequences:

  • each one is free not to contract.
  • each one is free to choose its contracting.
These two conditions are seen called into question with the appearance of the forced contracts , such as the contract of Assurance for example since one is forced to contract.
