Contract of good use

In France, the Contrat of Good use (CBU) of the drugs aims to improve and make safe, within an health care institution, the circuit of the Médicament , products and services mentioned with the article L. 165-1 of the code of the Social security and to guarantee their good use.

He is concluded for one duration from three to five years, between the director of the Regional office of the hospitalization (ARH) and the legal representative of the establishment after assent of the Medical Commission of Establishment (CME).

N the other hand respect of the commitments outstanding by the health care institution, a rate of refunding of 100% by the Health insurance is guaranteed to the establishment. (for the proprietary medical products and the products and services mentioned with the L.62-22-7 article of the code of the social security).

In the event of non-observance, the rate of refunding can be reduced between 70% and 100%. (D.162-13 article of the code of the social security.)

This contract of good use is control by the Regional office of the hospitalization (ARH), in the case of a manifest inexecution of the outstanding commitments, the director of the ARH can proceed to the cancellation of the contract under the conditions envisaged with article D. 162-15 of the code of the social security.

Improvement and security of the circuit of the drug and the products and services

The establishment carries out an inventory of fixtures of its situation by taking account of the results of the procedure of certification implemented by the High health official (HAS). (Extracted Article 3)

The establishment must according to the respect of the reference frames of good practices has minimum to carry out the following points (Extracted Article 3):

the Computerization of the Circuit of the drug and the circuit of the products and services;
the development of the regulations and the dispensation personal delivery;
the Traceability of the Regulation, with the administration for the drugs or the use for the products and services;
the development of a system of quality assurance;
in addition, in so far as the health care institution is concerned, the centralization of the preparation under the responsibility of a Pharmacien of the anti-cancer treatments.
