Constitutional court of Korea
The Constitutional court of Korea is a South Korean independent and specialized legal body whose role first is to examine the constitutionality of the laws in accordance with the Constitution of the République of Korea. It also recovers competences concerned with the administrative law such as the payment of the conflicts of capacity between governmental entities, the final decision of Impeachment and judges dissolution of the political parties.
Composition
The court is made up of nine judges. Three of the judges are named directly by the President. Among the six judges remaining, three are named by the Supreme Judge of the Supreme court and three others by are named within candidates elect by the National Assembly. Moreover, the chief of the court is named by the President with the assent of the National Assembly. The judges exert their functions during six years renewable mandates and are constrained to leave their station reaches the 65 years age, except the chief of the Constitutional court which is authorized to exert until the 70 years age.It is interdict with the Judges of the Constitutional court to adhere to political parties or to carry on any political activity as orders it article 112 subparagraph 2 of the Constitution. Moreover, the law prohibited with the judges of the Constitutional court to carry on any economic activity, or remunerated or to hold other public office.
History
The current Constitutional court dates from the beginning of the Sixth Republic of South Korea in 1988 and was established by Chapter VI of the Constitution. Although there existed before the Sixth Republic bodies in charge of the examination of the constitutionality, none of them was active. Indeed, before the establishment of the current Constitutional court, these bodies had made only three decisions since 1960, whereas the current Constitutional court did not regulate less than 400 businesses on 500 qu ' it of treating during the first year of its starting.
