Constitutional council (Senegal)
The Constitutional council is an public institution of the Senegal, more the high authority of the legal system.
It presents similarities with the French Constitutional council.
History
The Constitutional council of Senegal was created in 1992, when the Supreme court was removed and replaced by three specialized bodies.He was instituted by the law n° 92-23 of May 30th, 1992, modified by the organic law n° 99-71 of February 17th, 1999.
Organization
The Constitutional council includes/understands five members who are named by decree for six years nonrenewable, of which a President and a Vice-president. He is partially renewed every two years, at a rate of two members to the maximum.
Competences
At the time of the national elections (presidential or legislative), the Constitutional council receives the provisional results proclaimed by the Courses of call, takes a decision on possible the recourse and complaints and proclaims the final results.He also controls the constitutionality of the laws and international engagements. In the event of conflict of competences, it belongs to him to decide between the Council of State and the Court of appeal, the executive power and the legislative power.
