Constitution of Bamberg
The constitutional Charter of the Republic of Bavaria of August 14th, 1919 Freistaat. --> ( of Verfassungsurkunde of Freistaats Bayern vom 14. August 1919 ), known as the constitution of Bamberg ( of Bamberger Verfassung ), was a Constitution adopted on August 12th, 1919 by the Bavaria and promulgated the August 14th. It holds its nickname of the town of Bamberg, in Franconie, where Landtag and the Government had settled temporarily after having fled the République of the councils of Munich.
It was the democratic first Constitution adopted by Bavaria; the election of the constituent , on January 12th, 1919, had been the first by the vote free, equal, direct and secret.
It founded a parliamentary Régime bicameral and rationalized, and introduced various provisions which will miss with the Constitution of Reich adopted the same year and will be adopted with the federal level only with the fundamental law of 1949, in particular the legitimation of the Head of government by the absolute majority of the legal number members of the Parlement, the Contrôle of constitutionality, and the individual recourse in unconstitutionality against Loi S or payment S.
It devoted to more an high degree that the Constitution of Reich the principle of Collégialité of the cabinet: it formally allotted to the minister-president only very few rights and in particular any competence of orientation of the government policy, and for principal function the formation of the cabinet gave him. This brings the text closer to the federal constitutional Loi adopted by the Austria the following year.
The constitution known as of Bamberg came into effect on September 15th, 1919. It ceased being applied, without formally being abolished, after the installation of the Nazi regime and the promulgation of the law of January 30th, 1934 to the reorganization of Reich; the Constitution of the Republic of Bavaria adopted on December 2nd, 1946 replaced it after the Second world war.
