The Congrès of New Caledonia is the assembly deliberating on the New Caledonia. It is the heiress of a long institutional past and has, with the wire of the history of the Territory, known several names and operating processes: the general advice of 1885 with 1957, the territorial Parliament of 1957 with 1985 then the Congress of the Territory of 1985 with 1999. It sits at 1, boulevard Vauban in the center town of Noumea. The local mediums tend to speak about the “Vauban boulevard” to quote this institution.
Mode of election
The Congress is elected every 5 years at the same time as the provinces. In truth, the 54 members all of the Congress are of the elected officials of the Assemblies of Province, at a rate of: “seven members of the assembly of the province of the islands Honesty, fifteen of the assembly of the Northern province and thirty-two of the assembly of the Southern province”.
Inner working
The president
The president of the Congress is elected by the members of this institution at the time of the inaugural session of each annual session of the Congress. If no candidate for this station obtains the absolute majority of the votes (28 votes) at the time of the two first ballots, the relative majority is enough for the 3rd turn. This election is renewed every year, with the opening of each session.
The current president, since the July 31st 2007, is Pierre Frogier, of the Gathering-UMP. He was elected with a very vast absolute majority with the first ballot by joining together behind him the totality of the votes anti-freedom fighters: the voices of its party (13) and the three former members of its group who made dissidence since 2004 (including two only elected officials of the Congress belonging to the Rassemblement for Calédonie of the former deputy Jacques Lafleur), like 15 of the 16 elected officials of the group Avenir together (only the elected independence one of this party, Christiane Gambey, having blank vote) and the 4 elected officials of the local National front, are a total of 35 votes out of 54. The independence candidate, Jean-Pierre Djaïwé, filled for its part the tank with the votes of FLNKS, that is to say 18 votes, distributed between the two groups PLAIN - FLNKS (9 elected officials, of which Jean-Pierre Djaïwé) on the one hand and Union calédonienne (8 elected officials) on the other hand as well as only elected official of LKS Nidoïsh Naisseline. The two principal parties anti-freedom fighters, the Future together and the Gathering-UMP, enemies since the provincial elections of 2004 (with the Future together with the head of the institutions and the Gathering in the opposition), thus approached following the election Nicolas Sarkozy (supported by a very vast majority of the members of the two parties) and with legislative which saw a rather comfortable victory of the candidates of the Gathering-UMP while those of the Avenir together did not reach the second turn in any the districts. A political agreement was signed between the two formations, under the mediation of the UMP and the presidency of the Republic, for the creation of a largely majority coalition to the Congress like with the Parliament of the Southern Province. This agreement envisaged in particular the election of Pierre Frogier, president of the Gathering-UMP, with the head of the Congress and the presentation of a joint list of the two parties for the election of the government whose presidency returned to Harold Martin, leader of the Avenir together.

Role and competence
The vote of the laws of country and the transfers of competence
The Congress is the legislative body of the Territory. He thus votes the laws of country, in the majority absolute, which are presented to him by the Government or which are proposed by one or more elected officials of the Congress. It is him also which votes, in the majority of the 3/5, the transfers of competence of the State towards the Territory.
The election of the Government of New Caledonia and its control
At the beginning of each mandature, the Congress elects, with the list system presented by the parties represented, the Gouvernement of New Caledonia after having determined the number of its members (between 5 and 11). The current government, elected the August 6th 2007, comprises 8 members (4 Avenir together and 4 Rassemblement), but is only temporary and must only manage the go concern since the three freedom fighters which was to form part of it (2 PLAIN FLNKS and 1 Union calédonienne) resigned the very same day of his formation as all their following of list following what they estimate to be a material error which has occurred during the poll, an independence bulletin having been lost because entered no one (being stuck to a blank vote). This resignation causes fact thus the meeting of a new poll from here at 15 days as from the August 6th 2007 to indicate a new government. While waiting, the “provisional” government reduced to its only members anti-freedom fighters obtained the August 7th a president, Harold Martin (Avenir together), and of a vice-president, Annie Beustes (Gathering-UMP). Finally the August 21st 2007 the Congress proceeded to the election of the Seventh Government of New Caledonia resulting from the Accord of Noumea, always chaired by Harold Martin. The Congress can reverse a government as a voter very well a motion of censure in the majority of the 2/3.

Initially called group Gathering-UMP - FCCI, because of its traditional alliance with the independence small part moderate FCCI, and composed of 17 members (16 RPCR and 1 FCCI), it suffered from four defections: that of Suzie Vigouroux as of 2004, that of Francoise Sagnet-Chaverot in 2006 and of Simon Loueckhote in 2007, for what it is necessary to add the departure of the elected official FCCI for the group Union calédonienne in November 2004. Thus from now on, the group of the Gathering-UMP, chaired initially to Pierre Maresca and since 2007 by Cyntia Ligeard, counts nothing any more but 13 members.
