Company and trade register

The trade register and the companies was created in 1919 in order to constitute an instrument of knowledge of the French companies and information of the thirds, thus making it possible to ensure the safety of the business world. The RCS is thus presented as a rack which centralizes a certain number of legal information. In France, all moral Natural person or which with the quality of tradesman must be registered with the Trade register and Companies (RCS).

The RCS is held by the Clerc's Office either of a bankruptcy court, or of a Magistrates' court or great authority. The RCS of the various clerk'ss office of courts are centralized in the RNCS (National Register of the Trade and the Companies) by INPI. The bearing bill reforms legal protection of major should, if it passes the stage of the Constitutional council, withdraw the management and the conservation of the RNCS with the INPI to entrust it to the Clerc's Offices bankruptcy courts.

The register of trade is in fact a heritage of the German right. Indeed when the France recovered Alsace and Lorraine after the First World War in 1918, this part of the territory was dominated by the German right. Indicator that this system functioned well with the German companies, the France decided to introduce it into our law by a posterior law.
