Common partner

In France, the statute of common partner was instituted by the law of the July 16th 1971 on fusions and common regroupings of , called “Law Marcellin”. It allows communes removed during a fusion to preserve some characteristics:

A fusion of communes during which common partners are created is described as fusion-association (or fusion complexes ), in opposition to the simple fusion .

  • Bordeaux fusion with Caudéran in 1965 ( Bordeaux 230600 inhabitants in January 2005 ).

  • Cherbourg fusion with Octeville in 2002 ( Cherbourg-Octeville 40700 inhabitants in January 2005 ).
  • Dieppe fusion with Neuville-lès-Dieppe in 1980 ( Dieppe 33600 inhabitants in January 2005 ).
  • Dunkirk fusion with Malo-the-Baths in 1970, Small-Synthe and Rosendaël in 1972 and Mardyck in 1980. Mardyck becomes common associate ( Dunkirk 69500 inhabitants in January 2005 ).
  • Le Havre fusion with Bléville in 1953, Sanvic in 1955, Round slices in 1973 ( Le Havre 183900 inhabitants in January 2005 ).
  • Lille fusion with Hellemmes in 1977 and Lome in 2000, Hellemmes and Lome becomes common associates ( Lille 225100 inhabitants in January 2005 ).
  • Saint-Malo fusion with Paramé and Saint-Servan in 1967 ( Saint-Malo 50000 inhabitants in January 2005 ).
  • Saint-Etienne fusion with the Saint-Victor-on-Loire in 1969, then Rochetaillée in 1973 (( Saint-Etienne 175.700 inhabitants in January 2005 )

Common partners to January 1st: number and variation

At January 1st 2006, there were 730 common partners in France.

The majority of these common partners were created in the 4 years which followed the law Marcellin. Thereafter, their number fell under the effect of two combined tendencies:

  • in certain cases, the transformation of fusion-association into simple fusion (which removes the common partner completely);
  • in other cases, the “défusion” (which restores the common partner like commune with whole share). Thus the three communes of the Paddle having for names Bercenay-le-Hayer, Bourdenay and Trancault amalgamated on January 1st, 1973 in Valley-in Orvin, for défusionner on January 1st, 2000 with the profit of an other type of association (created in 1992), the Communauté of communes of Orvin and Ardusson (extended to additional communes).
