Law Malhuret
Very sensitive to the fate of the dissociated families and the fate of the children of the Divorce, concerned of a rebalancing of the parental rights, Claude Malhuret is at the origin of the law of July 22nd, 1987, which institutes the possibility of a common parental authority in the event of rupture of the couple and its maintenance after Divorce, the judge fixing the main home of the child. The terminology used before in the texts specified the parental responsibility on the child in term for " garde". Claude Malhuret made obsolete this term, replaced by those of residence and lodging, judged more capable to define the joint parental responsibilities in the interest for the child.
