Claude Gubler is a French doctor. He was the doctor of the president François Mitterrand.

The January 16th 1996, eight days after the death of the former president François Mitterrand, Doctor Claude Gubler affirms in this book that Mr. Mitterrand, reached of a Cancer, lied on his disease as of 1981. “Starting from 1994, writes it, it was not able to take up its duties” . The political community condemns these assertions. Its last Prime Minister, Edouard Balladur, and its former Foreign Minister, Alain Juppe, never state not to have noted an incapacity of Mr. Mitterrand to direct the country. Two days after its publication, the Great secrecy is withdrawn from the sale at the request of the family of the former president. The Juge of the summary procedures estimates that it constitutes “ an intrusion particularly serious in the intimacy of the private life and family ” of the president. July 5th, Doctor Gubler is condemned to four months of suspended sentence for breach of professional secrecy, which will also be worth to him to be erased Ordre of the doctors. The October 23rd, the Court of Bankruptcy of Paris maintains the prohibition of sale of the book and condemns Dr. Gubler and the Plon editions to be poured: 340000 francs of damages to the family of the former Head of State. This judgment will be confirmed by the Court of Appeal and the Court of appeal. But in May 2004, the European Cour of the human rights condemns France, estimating that the prohibition of the book should have been raised after a few months, in the name of the Freedom of expression.
