Chinese supreme popular court
The supreme popular Court (最高人民法院; pinyin: Zuìgāo Rénmín Fǎyuàn) is the high court in the legal system of the Popular republic of China.
HongKong and Macao, as a special administrative areas, has their own legal system based on the traditions of the Common law and the legal traditions Portuguese respectively, and leaves the framework of the supreme popular Cour .
Presentation
The President of the supreme popular Court is named by the National People's Assembly (APN, Parliament). The current president - since March 1998 - is Xiao Yang (肖扬), which was Minister for the justice of 1993 with 1998. He was re-elected the March 16th 2003, at the time of the 6th plenary session of the first session of the 10th National People's Assembly.
Role
The March 30th 2006, the Chinese ministry of Justice announced that three new courts, specialized in the criminal cases and concerning the supreme popular Cour - whose creation had been announced in October - charged with re-examining some death sentences formulated by the provincial courts, would be operational as of on April 1st. Previously this authority of call was most of the time spring of the provincial courts themselves. The supreme popular Court, in the current system, did not revise and made the final decision only in certain cases of death sentences - in particular when it was about economic crimes - but delegated this power to the provincial courts for other types of businesses.
