Chart of press in France

The chart of press is a professional indentity card which makes it possible the Journaliste to prove his activity, to reach more easily places which are used to him to obtain information (official press rooms, offices, museums, etc) and to take advantage of its right to the social protection provided in its profession.

Conditions of attribution of the business card

The chart of press is allotted by the Commission of the indentity card of the professional journalists in accordance with the law of 1935 (following the Rapport Brachard).
The article L 761-2 of the labor regulation, indicates that the professional Journaliste is that which has “as an occupation principal, regular and remunerated the exercise of its profession in one or more daily or periodic publications or one or more news agencies and which draws the main thing from it from its resources”.
CCIJP is thus brought to seek, for each request:

if it is indeed a principal and regular occupation (3 months consecutive for a first request)
if this one gets to the applicant the essence of its resources is more than 50%, when this figure is higher than 75%, obtaining is automatic.

More concretely, it has been necessary, if it is about a first request, to follow the occupation for at least three months consecutive, and to draw from this activity the main thing of its resources. The exerted functions must be of journalistic nature. Lastly, the employer must be a company of press (written or audio-visual) or a News agency approved.
However, according to the stop Edelson (Council of State April 2nd, 2002), a journalist working for a company which has as an activity the creation of audio-visual works intended to be disseminated to the public will be looked at as journalist even if the company of communication does not ensure this diffusion.
directly If they meet the conditions of the article L 761-2 of the labor regulation, the people who publish articles on Internet can profit from the statute of professional journalist. On the other hand, when the drafting and the setting in line of articles constitute the prolongation of another activity, the person will not be able to profit from this statute. In a stop of July 26th, 2007, the Council of State refused to admit the quality of professional journalist to the director of the site Sciences Current events of the City of Sciences.

For a renewal, the conditions to fill are the same ones, but the regularity of the activity is appreciated over the twelve months preceding the request.
The paten on a monthly basis wages must correspond to that of the scales in force in the category of media for the exerted function. For the payments '' with the measuring rod '', the monthly average (on 3 or 12 months) must approach SMIC.

Article 6 of the national Collective agreement of the journalists specifies that no company (of press) will be able to employ during more than three months of the professional and comparable journalists who would not be titular business card of the current year or for which this chart would not have been asked. This measurement does not apply to the local correspondents whose collaboration constitutes only one additional occupation .

Parts required at the time of the first request

When an applicant asks for the chart of press for the first time, it must provide the following documents:

the photocopy recto back of the national card of identity (delivered since less than 10 years), or of the passport with page comprising the validity, or of a certificate of registry, or, if necessary, valid residence permit. The foreign journalists, residing and working in France, must have a resident's card being marked " all professions salariées".
a CV with a specimen of the publications in which the applicant collaborates with the indication of carried out work (written press)
Two photographs of identity
a photocopy of the last three pay slips
an extract of Police records (national Police records - 44079 Nantes Cedex 1) going back to less than 3 months
a certificate from employer, specifying very exactly the exerted function and the amount of the salaries which must correspond to the annexed scale with the national Collective agreement of work of the journalists (or possibly photocopy of the contract or letter of commitment). These employers will regulate with CCIJP second half of the expenses of file
For the collaborators remunerated by the measuring rod, the certificate of employer will have to specify, in addition to the exact qualification, the amount of the measuring rods perceived over one three months period consecutive at least. The supporting documents will have to be united,
a certificate on the honor certifying that journalism is well the principal and regular profession.
the payment of the rights of file per bank check or postal.

the card of civil statue is not required any more.

Renewal

The chart of press is renewed each year.
The Journaliste must fill the form with request for renewal, and address it to the Commission accompanied by a certificate issued by its employer and by the last received pay slip carrying the office plurality annuel.
This request can also be addressed to the Commission by the means of the employer who, in this case, complete instead of the individual certificate a collective form holding place of employers' certificate.
The request for renewal is examined over the twelve months of activities preceding the date of filing of the file. This period is brought back to three months when it is about a rehabilitation (return to the profession after interruption).

Incompatibility

The article L 761-2 of the labor regulation established an incompatibility with regard to the publicity agents and the trade of Journaliste, which does not mean that the journalists occasionally cannot and in any case minoritairement to perceive commissions of an advertizing nature.
On the other hand, since October 1964, by decree of the Minister for Information, the functions of in charge of public relations and press attaché are completely incompatible with the statute of professional journalist, even if those are very additional taking into consideration journalistic activity.
Lastly, a third case of incompatibility was added in May 1986, by a stop of the Council of State which estimated that the statute of civil servant or contractual public agent is exclusive benefit of any other professional statute.
