Charles Demolombe

Charles Demolombe (born in 1804, deceased in 1887 or 1888) is a lawyer and interpète Civil code French, “prince of the Exégèse”.

Career

Charles Demolombe is consulting lawyer and professor with Caen. Occupied by the study of the Code, it declines any other activity such as the post of prosecutor to the Court of appeal, a post of professor in Paris.

He however is elected on January 23rd, 1864 with the Academy of Science morals and political in section of legislation in the place 5 at which John Austin sat (1790-1859).

The interpretation of the Civil code

It writes all its life a course, comment of the Civil code less elementary than those of Maleville and Pigeau. This course follows the plan of the Civil code.

The Code is still recent, the commentators are extremely respectful. Demolombe wishes to be restricted to work out from them the principles and to draw the logical consequences, step which evokes the Positivisme to come, it speaks besides about “science of the right”. It rejects the German influence defended by Alsatian the Aubry and Rau.

It takes part in the creation of the assessment of legislation and jurisprudence, first review to propose truths comments of stops.
