Business of the missings of Beach

The Affaire of the missings of Beach is a Congolese business under the mode of Denis Sassou-Nguesso.

Context

In 1999, to ensure appeasing, Denis Sassou announces the national reconciliation. It signs agreements with the Democratic republic of Congo and HCR for the return of the refugees who had fled the civil war while taking refuge in Kinshasa.

First return of families (adult, women, children) has place by “crossing of Beach” (river shuttle which carries out the Brazzaville-Kinshasa connections), and includes/understands approximately 1500 people, under the control of the HCR. These people are challenged as of their arrival with Brazzaville, conveyed by convoys in camps or towards the Presidency according to the sources. From this moment, all the traces will be lost. Certain rumors speak alive people piled up in containers, which would have been welded and thrown in the river.

Some people will be able to escape this tragic destiny, and will come to testify. One speaks amongst other things about a mongrel which as of its arrival with Brazzaville was authorized to leave the queue.

Lawsuit

In Brazzaville

Only some families will dare to carry felt sorry for the disappearance of 353 people.

The lawsuit takes place with Brazzaville in 2005.

Side of the capacity, several persons in charge will be supported by Congolese lawyers, but also the French Maître Rods.

The course of the lawsuit will be retransmis on Congolese television during a few weeks. A few hours before the verdict, the soldiers threaten, if their hierarchy would be condemned, to make a descent and exactions in the district of Mangrove swamp mud.

The verdict will recognize guilty several leaders, accompanied by various judgments. However, these persons in charge, considering their functions within the government, will be exempted of sorrow, and will take again their normal activity, in all quietude.

In France

The lodged complaints in France encounter difficulties. However, on January 10th, 2007 the French court of appeal indeed ordered the continuation of the instruction cancelled in 2004 by the Court of Appeal of Paris for legal flaw.
