Business of the false voters of the 3rd district of Paris

The business of the false voters of the 3rd district of Paris is a business of electoral Fraud which would have consisted in registering per hundreds on the electoral rolls of the 3rd district of Paris of the people who did not reside at it, in order to ensure a victory of the majority RPR - UDF in the district the municipal elections of 1989 and 1995.

According to a list found fortuitously in the computers of the town hall of the 3rd district in 1995, of many members more or less far away from the family of Jacques Dominati, the drivers or former drivers of UDF and the town hall like their wives, had been registered fraudulently.

Chronology

  • January 4th, 1989: A few weeks before the municipal elections of 1989, the weekly magazine the Canard connected publishes a denouncing article of the illegal inscriptions in Paris of voters not residing there.

  • January 9th, 1989: Four voters ecologists deposit felt sorry for in Paris with constitution of civil part. A fraud with the " faux" voters is suspectée in several Parisian districts, but the investigations will quickly limit to only the 3rd district.

  • February 15th, 1989: The Court of appeal returns the file to Amiens under the terms of the privilege of jurisdiction which imposes then the expatriation of the files blaming of the elected officials. The judge Brice Raymondeau-Castanet sees himself entrusting the instruction of the business.

  • March 12th and 19th 1989: Jacques Chirac and lists UDF-RPR gain the victory in the twenty Parisian districts, carrying out the " large chelem".

  • January 15th, 1992: A first report/ratio of gendarmerie assure to the fraudulent inscription voters on the electoral rolls of 3rd and other districts of Paris.

  • December 21st, 1995: After the victory of the left in the 3rd district with the municipal elections of 1995, the Green elected official Yves Contassot and the socialist militant Pierre Montacié give to the justice of the electronic files counting of the " faux" voters. The name of Jack-Yves Bohbot, former assistant of Jacques Dominati, appears 180 times.

  • February 7th, 1996: New legal information is opened in Paris by the judge Herve Stéphan. The judge of Amiens deprives himself of the file.

  • December 5th, 1997: The continuations are extended for suspicions of " fichage" voters according to their political opinions in the computers of the town hall of the 3rd district.

  • May 25th, 2000: The new examining magistrates Jean-Paul Valat and Philippe Coirre put in examination fifteen ex-elected officials or former officials of the 3rd district, suspected of having mobilized political, family or professional networks in order to register unduly on the electoral rolls of the political sympathizers.

  • July 8th, 2000: Gerard Blackbird, former head of the Parisian section of RPR and witness, declares with the investigators that Jacques Chirac wanted to repurchase the presidential one lost of 1988 " by a victory in the twenty districts of Paris to the local elections of 1989". Pierre-Alain Brossault (Green) then claims with the judges to audition Jacques Chirac like witness. Its request is rejected. A decision which is confirmed in call then in cassation in 2002.

  • March 18th 2002: The end of the instruction is notified to the fifteen people put in examination. Among them appear in particular the former mayor of the 3rd district, Jacques Dominati, his two sons, Laurent and Philippe, as well as the old right-hand man of Jean Tiberi with the RPR federation of Paris, Guy Legris, also implied in the business of the Municipal credit of Paris.

  • December 17th, 2004: In his indictment (170 pages plus some 500 pages of appendices), the public prosecutor recommends the reference in front of the magistrates' court of the fifteen people put in examination.

  • September 11th 2006: Opening of the lawsuit in Paris. Fifteen defendants appear for " operations frauduleuses" at the time of the municipal elections of 1989 and 1995. They incur up to one year of prison, 15.000 euros of fine and a sorrow of ineligibility.

  • December 19th 2006: Jacques Dominati and his Laurent son are released whereas 10 of the 14 defendants are condemned to sorrows of fines or suspended sentences.

Dominati (the father Jacques Dominati, the Philippe brothers and Laurent Dominati, were put in examination in this business.

Judgment in first authority

Seventeen years after the revelations of Duck, the business of the false voters of IIIe district was judged in September 2006 by the 16th room of the magistrates' court chaired by Jean-Claude Kross. Dominati were to answer of " operations frauduleuses" having " attacked the sincérité" municipal elections of 1989 and 1995.

For them “there were not false voters (but) of the militant actions, voters who wanted to help the elected officials places from there quite naturally, as that was done at the time everywhere”.

Jacques Dominati threatened with the audience to produce a list of elected officials who would have had recourse to these irregular practices, supporting that the practice was generalized. " I have a list of colleagues of the opposition who sat on the same benches as me, which were in the same situation. If you ask me for this list, I will be obliged to provide it ".

The October 25th 2006, the parquet floor of Paris required against Jacques Dominati a twelve months of suspended sentence, 2.000 euros of fine and five years sorrow of ineligibility. The prosecutor

In December 2006, the judgment confirms the culpability of 10 of the 14 defendants:

  • Jacques-Yves Bohbot: 12 months with deferment, 2000 € of fine

  • Guy Legris: 12 months with deferment, 2000 € of fine
  • J Bidel: 10 months with deferment, 2000 € of fine
  • Mr. Castets: 10 months with deferment, 2000 € of fine
  • C Fournerault: 10 months with deferment, 2000 € of fine
  • Philippe Dominati: 6 months with deferment, 2000 € of fine
  • there Mazoyer: 6 months with deferment, 2000 € of fine
  • P Grundmann: 2000 € of fine with deferment
  • Mr. Theuillon: 2000 € of fine with deferment
  • L Bourguigon: exempted culprit but of sorrow.

The fraud having profited with the election from Jacques Dominati in 1989 is proven just like the fraud noted in 1995. However, Jacques Dominati and his Laurent son are released of any infringement.
