At the human beings, the period of nine months gestation which precedes the birth is called the Grossesse. The birth occurs with the Accouchement when the child is expelled of the maternal belly, then that the Umbilical cord is cut, and the child capable of an autonomous respiratory activity.

However, the very strict definition of the moment of the birth has very many consequences in morals and the right.

In right, the birth defines the starting point of the existence of a person: a person who is born acquires of office a legal Personality , source of rights (in particular the Droit to the life) but also of obligations. Thus, once born, any act going against the integrity of the life of an human being can be apprehended like a Homicide. Two behaviors are particularly aimed: the Abortion and medical non-assistance with a child which one estimates that it will not be viable. But, there is also the case of died of the fetus: a person who accidentally kills a fetus in the belly of her mother (car accident, poisoning, ill-treatments…) is it guilty of a homicide? The question is distinct differently according to the various national rights according to the clean social representations of this State.

Indeed, in morals and the religion, the question of the birth was generally discussed a long time to feed the legal questions about the right of the child to be born and the not-viable child. Augustin d' Hippone, theologist and Father of the Church, reflected in particular much on the question of the animation, i.e. the moment when the fetus is equipped with a heart. Today still, most of the combat of the collectives pro-life against the abortion rests on the recognition of rights to the child to be born.

Lastly, it should be noted that birth with other legal and social consequences. First of all, the birthplace is source of rights and duties, in particular as a determinant of the Nationalité for the countries in favor of a Droit of the ground. And the birth date is used at several ends: it is used to enter the age of a person and to define its date of Anniversaire, it will have in particular legal consequences by the concept of Majorité. According to whether it is located or not in the course of a Mariage, the birth date defines the concepts of child legitimates and of natural child. The birth date is also used in Astrologie to define the Horoscope and the birth Chart of a person.

Christmas is a Christian festival which celebrates each year the birth of Jesus-Christ. The exact birth date of Christ being unknown, her festival was fixed liturgiquement the December 25th in the majority of the countries.
