Arbitration court of the sport
The Arbitration court of the sport is an international institution proposing an arbitration or a mediation in the world of the sport. Based with Lausanne, it depends on the International counsel of the arbitration as regards sport (CIAS).
History
In front of the multiplication of the conflicts, the president of CIO Juan Antonio Samaranch initiated the creation of the HEAP as of 1981. In 1983, the CIO recognizes officially the HEAP, from which competence begins the June 30th 1984. Its sphere of activity is initially limited, but since the signed “agreements of Paris” the June 22nd 1994, its competence is widened and its institutional link with the CIO is abolished in order to respect the decision of the Swiss Federal court which had pointed this problem. Thus, the HEAP is today an organization completely independent of the sporting federations.The topics most often evoked in front of the HEAP are the problems of doping and the arbitration during certain transfers of footballers in order to fix the amount of the allowances of transfer when the two clubs, the purchaser and the salesman, do not manage to find an agreement. FIFA was a long time hostile with the HEAP and its competence only in December 2002 recognized.
In 2005, the HEAP treated 194 requests for arbitration and 4 requests for advisory opinions. Between 1986 and 2005, the HEAP treated 970 requests for arbitration and 75 requests for advisory opinions.
Organization
Four forms of procedures exist: the ordinary arbitration, arbitration procedure of appeal, consultation procedure and procedure of mediation.Formerly composed referees named by the sporting CIO and federations, the HEAP counts from now on 150 referees resulting from 55 different countries, selected for their knowledge of the right of the sport.
