Anicet Pors

Anicet Pors , engineer of formation, born the April 28th 1931 with Paris - 13 {{E}}, is a French politician.

Biography

  • It was one of the four communist ministers of the government of Pierre Mauroy of 1981 with 1984, where it accepted the wallet of the Public office. It initiated a reform including/understanding a new statute of the civils servant, tending to unify the three public office (of State, territorial and hospital) and privileging the access to the service of the State by the way of the contest.
  • Senator of the Hauts-de-Seine of 1977 to 1981, general adviser of the Hauts-de-Seine of 1985 to 1998.
  • To advise State since 1985.
  • President of section at the Commission of the recourse of the refugees (France)

It occupied the following functions successively:

  • 1953-1965 Engineer with the French Central Meteorological Office with Marrakech, Casablanca, Léopoldville and Paris

  • 1958-1994 Member of PCF and his central committee (1979-1993)
  • 1965-1977 Operations manager with the direction of the forecast of the ministry for the Economy and Finances, chief of the office of Industry

  • 1977-1981 Senator of the Hauts-de-Seine
  • 1978-1980 Part-time lecturer at the University with the economic scenes and commercial (ESSEC)

Detail of the governmental functions

  • Deputy secretary near the Prime Minister, in charge with the Public office and the Administrative reforms of the Government Pierre Mauroy (2) (from June 23rd, 1981 to March 22nd, 1983)
  • Secretary of State near the Prime Minister, in charge with the Public office and the Administrative reforms of the Government Pierre Mauroy (3) (from March 24th, 1983 to July 23rd, 1984)

The public office, up to that point limited to the administrations of the State, was extended to the territorial collectivities, the hospital public corporations and the public corporations of research, making pass the number of civils servant under statute of 2,1 million to some 5 million.

The public office, known as henceforth “with three slopes”, was organized by four laws constituting the successive titles of the new architecture of the general status of the civils servant:

  1. Title 1st - Rights and obligations of the civils servant (law n° 83-634 of July 13rd, 1983
  2. Title II - Public office of the State (law n° 84-16 of January 11th, 1984)
  3. Title III - Territorial public function (law n° 84-53 of January 26th, 1984)
  4. Title IV - hospital Public office (law n° 86-33 of January 9th, 1986)

Principal statutory novations were the following ones:

  • In the Title 1st: The replacement of the good morality like access term with the public office by the mentions with the bulletin n° 2 of the police records, the suppression of the references to tuberculosis, cancer and the mental diseases (current Article 5); freedom of thought (Article 6); the replacement of the nature of the functions by the concept of determining condition of the exercise of the functions in separate recruitments man-women as well as the publication every two years of a report/ratio on the equality (Article 6 (a) and S.); right to the negotiation on remunerations, the conditions and the organization of work recognized with the trade-union organizations (Article 8) and deposit of a report/ratio every two years (Article 15); right to strike (Article 10); mobility enters and inside the public office as guaranteed fundamental (Article 14); right to continuing education (Article 22); obligation of information (Article 27); etc

  • In Title II: The 3rd access road to the ENA (Article 19); institution of the complementary list (Article 20), of the provision (Article 41); the establishment of contractual (Article 73), etc
  • Titles III and IV were entirely new.

In addition, in the lawful field or of the circulars, for example: the circular of August 7th, 1981 on the full competence of the CTP; the circular of August 24th, 1981 on the use of the administrative buildings for activities other than of service; decrees of May 28th, 1982 (trade union rights of which the monthly hour of trade-union information, CSFP, CAPE, CTP, CHS); the decree of November 28th, 1983 on the relations between the administration and the users, etc
