Allotment

A allotment is the division of a piece in several batches intended to be built. This operation requires the development of these grounds. By extension, one speaks about allotment to define the districts thus formed, some was the legal mode of their creation.

Description

The allotment is an operation of Urbanisme which allows an private operator or public, Local government agency (generally a common ), an office HLM, or any owners unspecified, to urbanize part of its inheritance by having recourse to a private promoter (a community can also carry out an allotment, the " promoteur" is then the public power). It is the latter which builds the elements of Viabilité: Road S and green areas, Network X of Cleansing, public lighting, adduction of Drinking water, etc and which is remunerated by selling the arranged pieces. That avoids with the community financing important Investissement S.

The term indicates also the district thus arranged; one speaks, for example, of private housing estate. But it is not the only form of allotment which exists. Indeed, one should not forget the basic definition of the allotment: the division of a piece in several batches: thus it is also possible to use this technique to develop retail parks, industrial and artisanal.

In France, the allotments are governed by the law of June 21st, 1865, called on the property owners' syndicates. Indeed, an allotment is characterized by the existence of common equipment which serves privative pieces. Those are private properties individual, while the common equipment, which include/understand the streets, the sewer S, the green areas, etc, are managed collectively by a Property owners' syndicate of allotment. This situation can be perennial, if such is the will of Co-parcelled out, or transient if those wish, provided that the community accepts it, that this equipment commun runs are transferred in the communal public domain.

An allotment can give rise to true a Ville: thus the Touquet-Paris-Beach was created in 1880 in the form of an allotment, and was set up in commune in 1912.

In France, the situation is particular, is considered allotment any division of a piece with an aim of making parcel out within 10 year in addition to two parts. There exists also the situation of the allotment unilot. The situation is rather simple, an owner wishes to make divide his piece into three batches: the two batches will be regarded as normal, the third batch will be regarded as an allotment unilot with an obligation of license to parcel out. The file of realization of allotment is relatively heavy. Indeed, it is necessary to constitute a made up form of request:

  • of a presentation of the project

  • of a plan of situation
  • of an inventory of fixtures
  • of an impact study
  • of a plan of composition
  • of a payment
  • of a plan of work
  • of a program of work

But starting from October 1st, 2007, procedure of request to parcel out exchange. A " will have to be asked; license of aménager" if division implies the creation of more than two batches, either in a classified site or a safeguarded sector, or including/understanding common equipment or spaces. In the contrary case, it will be advisable to proceed by " declaration préalable" , whatever the number of batches created (including 1 new batch) and this, in both cases.
