Action of the State at sea

The increase in the maritime transport and the loadings at the risks, the development of the economic activities or leisures at sea involved an evolution of the role of the State at sea. One at sea gathers under the term of Action of the State all the missions raising at sea of the State, except for the missions related to the National defense.

These missions include/understand missions of administration and management, but also of the missions of police force and operational missions.

The action of the State at sea thus gathers missions concerned with several ministries, in particular:

The operational missions of action of the State at sea are ensured, according to the countries, by the means of one or more public administrations:

  • marine soldier;
  • Coastguard;
  • gendarmerie and/or maritime police force;
  • maritime businesses;
  • civil security;
  • Customs S;
and if necessary by associations or privately held companies to which are entrusted public service missions (for example help rescue at sea).

In France

The French device of action of the State at sea rests on two bases: coordination between administrations having of competences and means at sea and the implication of the ministry for defense. The rescue of the people and the goods, the prevention of pollution and the fight against pollution exerted a strong motivation leading the State at sea to structure its capacity of action.

the missions concern: - Maritime security and rescue at sea - Maritime and harbor Safety - Fight against the illicit traffics - Action of the State against the illicit rejections at sea (voluntary pollution) - Fight against illegal immigration by the sea route - Monitoring and control of fishings

Interdepartmental in its principle and inter-administrations in its operation, the action of the State at sea (AEM) is directed by the Prime Minister. More than ten ministries contribute, with titles and, with the intervention of the State at sea.

The ministries for Defense, Finances and Transport, which has naval means, are more specifically inserted in a device of coordination, for the needs for the missions defined by the decree of February 6th, 2004 relating to the action of the State at sea: “the defense of the sovereign rights and the interests of the nation, the maintenance of law and order, safeguard of the people and the goods, the environmental protection and coordination of the fight against the illicit activities”.

In France, the Action of the State at sea is coordinated by the Prime Minister, through the General secretary of the sea.

The decentralized authority of the State is entrusted in this field in metropolis to the maritime police chiefs. Overseas, it is entrusted to the prefects (DOM) or to the High-Commissioners of the government. At the daily newspaper, each administration preserves its own responsibilities at sea. When coordination becomes necessary, a powerful and unquestioned authority with the more meadows of the zone of intervention leads the action at sea: it is the maritime police chief.
